Patton  Boggs litigates a wide variety of cases involving environmental issues.  We defend companies when EPA or state environmental authorities threaten or bring civil or criminal enforcement actions for alleged environmental law violations.  In those situations, Patton Boggs attorneys, many of whom formerly served in the federal government, often can utilize their knowledge of the enforcement agency’s procedures and personnel to resolve the alleged violation without resort to litigation.  In instances where litigation is unavoidable, though, the firm is adept at, and has experience, defending civil or criminal actions brought under all of the extensive environmental statutes.

We also frequently litigate on behalf of companies involved in energy or other development projects.  Often, project opponents bring litigation challenging environmental permits or other authorizations for development.  By devising creative solutions, the firm is often able to attain favorable settlements of these challenges and avoid litigation.  Patton Boggs litigators also handle high-profile, cost-recovery actions under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA).  In a number of these cases, we have successfully pursued creative new theories of liability to reduce or eliminate claims against our clients.  In addition, we have extensive experience dealing with the federal Oil Pollution Act, particularly in claims for environmental cleanup costs and natural resource damages brought by federal and state agencies under that statute.
