Amy Davine Kim advises clients in the areas of U.S. regulation of international business, financial services and international private equity transactions.

Ms. Kim advises clients on a variety of complex issues concerning the U.S. regulation of international business and financial services. In particular, she provides legal advice and assistance to financial services companies and other clients involving federal and state regulatory compliance regarding anti-money laundering and electronic payments matters regulated by the Consumer Financial Protection Bureau (CFPB),  the Financial Crimes Enforcement Network (FinCEN) and state agencies governing money transmitters. In addition she advises clients with respect to contractual agreements between financial services companies and third parties establishing payments programs. Representative matters include drafting program manager agreements required for payments programs, responding to bank regulator inquiries regarding Reg E, Reg P and UDAAP compliance, and addressing regulatory issues regarding state money transmitter requirements. 

Ms. Kim further advises clients in matters involving the Foreign Corrupt Practices Act (FCPA) the Office of Foreign Assets Control (OFAC), and anti-boycott laws. She develops international compliance and training programs involving these laws, and advises on specific matters and transactions governed by such laws.

With respect to private equity transactions, Ms. Kim advises on the legal aspects of structuring and participating in investment funds that make corporate securities and real estate investments worldwide. She routinely counsels clients and foreign institutional investors in technical matters related to the partnership, corporate and limited liabilitycompany agreements that establish these investments.

Ms. Kim has a strong commitment to pro bono legal work and has assisted individuals who cannot afford a lawyer in maneuvering the D.C. family court system.  In addition, she has worked closely with children’s and maternal health organizations to advance their programs and advised on bipartisan legislation involving missing and exploited children.
