Andrew McNally concentrates his practice in toxic tort, environmental litigation and general litigation matters. Mr. McNally has also represented clients in a variety of civil practice areas, including professional liability, insurance, construction and trademark. In addition, he has represented clients in criminal matters, including criminal appeals.

Mr. McNally served as trial counsel for a real estate developer in a month-long federal trial, obtaining a judgment that certain government agencies and private parties were liable for remediation costs under various environmental statutes, as a result of TCE groundwater contamination.

Mr. McNally provided pro bono representation for the mother of an American-born child before the United States Court of Appeals for the Third Circuit in a matter involving a petition brought by the child’s father contending that the child should be sent abroad for a custody determination pursuant to the Hague Convention on the Civil Aspects of International Child Abduction. From the bench, the Third Circuit overturned the prior order of the district court granting the petition, allowing the child to remain in the custody of her mother in United States.

Mr. McNally presently serves as vice chair of the Patton Boggs Foundation Associates Advisory Committee.

While pursuing his law degree, Mr. McNally served as a comment editor for the Seton Hall Law Review, and authored “Revitalizing Selective Waiver: Encouraging Voluntary Disclosure of Corporate Wrongdoing by Restricting Third Party Access to Disclosed Materials,” cited in In re Quest Commc’ns Int’l Inc., 450 F.3d 1179 (10th Cir. 2006) and In re Natural Gas Commodity Litig., 2005 WL 1457666 (S.D.N.Y. 2005). Mr. McNally also served as a clinical practitioner at the Seton Hall Center for Social Justice, earning the “Outstanding Clinical Practitioner Award.”

Prior to attending law school, Mr. McNally originated and approved multi-million dollar loans for a global wealth management company and broker-dealer.

Representative Matters
  • Defended a large metropolitan municipality and more than 150 contractors and subcontractors regarding personal injury allegations during the rescue and recovery efforts, as well as the debris removal and cleanup operations following a terrorist attack.
  • Represented chemical manufacturer in litigation with purchaser of client’s former facility, obtaining a ruling that the purchaser and its parent company were obligated to indemnify client for all CERCLA and New Jersey Spill Act costs relating to the cleanup of the Lower Passiac River in New Jersey.
  • Represented group of investors in settlement of securities fraud claims against accounting firm.
