Anne Spiggle advises clients on a wide range of regulatory and public policy matters involving the Food and Drug Administration (FDA), the Federal Trade Commission (FTC), the Consumer Product Safety Commission (CPSC) and other federal and state health and safety regulatory agencies.

Ms. Spiggle counsels clients on compliance with federal and state regulatory requirements relating to the development, promotion and sale of foods, dietary supplements, drugs, cosmetics, medical devices and tobacco products. She also provides assistance to clients responding to regulatory enforcement actions, including FDA Warning Letters, product seizures, import alerts and detentions, recall requests, inspection disputes and agency investigations. In addition, Ms. Spiggle assists clients in conducting regulatory due diligence on corporate transactions and private equity investments. 

Ms. Spiggle’s practice includes advising clients regarding FDA requirements and FDA-related regulatory submissions such as Citizen Petitions, New Dietary Ingredient (NDI) submissions and comments on agency rulemakings.   She also advises clients on CPSC-related issues, including Section 15(b) submissions and “Fast Track Recalls.” Ms. Spiggle also counsels clients on advertising and promotion-related issues involving the FTC’s Bureau of Consumer Protection and the National Advertising Division of the Better Business Bureau (NAD).

Before joining Patton Boggs, Ms. Spiggle monitored media trends and conducted quantitative and qualitative research on consumer food consumption and purchasing habits on behalf of a leading global advertising agency.

Representative Matters

FDA
  • Assisted multiple clients in drafting new dietary ingredient submissions to FDA.
  • Counsel to tobacco companies regarding regulation under the Family Smoking Prevention and Tobacco Control Act.
  • Counseled client in handling cosmetic product customs detention.
  • Represented drug company in submission of extensive comments addressing reimportation of prescription drugs.

FTC/NAD
  • Successfully defended dietary supplement company’s advertising claims before the National Advertising Division (NAD) of the Better Business Bureau.
  • Counsel infomercial companies regarding assorted compliance issues.
  • Counsel companies on compliance with the Telemarketing Sales Rule.

CPSC
  • Routinely submit 15(b) filings with the CPSC and coordinate product recalls on behalf of consumer product companies and retailers.
  • Advise multiple companies on compliance with the Consumer Product Safety Improvement Act of 2008 (CPSIA).

Transactional Work
  • Assist clients in conducting regulatory due diligence on corporate transactions.
