Michele Frank focuses her practice on intellectual property with an emphasis on client counseling, due diligence, asset transfer, licensing and transactional matters, patent portfolio management, opinions, and patent infringement litigation.
Ms. Frank’s mix of technical and legal knowledge and her understanding of the patent-granting and enforcement process have helped her become a leading patent specialist. As a former U.S. patent examiner, she successfully navigates difficult cases through the Patent Office and negotiates with examiners in personal interviews. With her litigation, patent prosecution, and strategic counseling experience, she assists clients in establishing and protecting valuable intellectual property portfolios within emerging technologies. She has developed portfolios and strategies to assist numerous early stage companies achieve successful acquisition by Fortune 500 companies.
Ms. Frank has led patent portfolio development, due diligence, and licensing negotiations on behalf of clients seeking to maximize their patent estates and market products globally. Her experience also spans accelerated examination, Board appeals, and reexamination. She advises technology companies, involved in, for example, the development of medical devices, respiratory technologies, ultrasonic periodontal systems, medical diagnostics, home health care monitoring systems, spectroscopy, optical discs, juvenile products, water desalination, hydrostatic transmissions, telecommunications, surveillance systems, business methods, internet technology, data storage, global positioning systems, computer graphics, software, and superconductors.
Ms. Frank has participated in all aspects of complex patent infringement litigation, including Markman hearings and jury and bench trials in various technological areas, including optical technology, business methods, internet technology, and medical devices in numerous federal U.S. courts including, for example, Delaware and the Eastern District of Texas. Representative litigations include handling highly complex patent litigation matters on behalf of client involving safety needles (Becton-Dickenson v. Tyco); handling highly complex patent litigation matters on behalf of client involving stents (Cordis Corp. v. Medtronic AVE, et al.); handling highly complex patent litigation matters on behalf of client involving compact disks (DiscoVision Associates v. Disc Manufacturing, Inc.); and defending companies against paper patent suits.
Ms. Frank was formerly a partner with Morgan Lewis LLP and early in her career was a patent examiner at the U.S. Patent and Trademark Office.
