James Graziano helps clients protect their intellectual property by both handling patent prosecution and developing patent portfolios in various high technology fields.

Going above and beyond, Mr. Graziano gains an understanding of a client’s relevant product market, its competitors, the present technology and trends, the corresponding international perspective, legislative trends in the various countries of interest to the client and licensing opportunities. He then integrates all of these factors into a coordinated intellectual property portfolio development plan that aggressively delimits the client’s present and future intellectual property rights. The patents filed in this process are broad in scope and interlocking in nature to present an eminently defensible patent position for the client.

In addition, Mr. Graziano has excellent success in challenging issued patents that are asserted against his clients. His approach in invalidating these patents is to understand the historical perspective of the technology, identify the primary contributors to the technology, the method by which innovations are propagated to the marketplace, sources of relevant publications and the nuances contained in the prosecution of the asserted patents. This multidimensional analysis identifies potential weaknesses in the asserted patents and frequently results in the patents being invalidated.

Mr. Graziano has 40 years of technical and legal experience in the fields of: cellular systems, Internet-based systems, data storage systems, robotics, imaging systems, neuromorphic systems and in the medical device field including impairment detection. As an inventor himself, he has 16 issued U.S. patents in the fields of electronic contracts, cellular communications and self-configuring wireless networks. He also has numerous pending U.S. patent applications in the field of multimedia management, emergency services notification, smart grid, electric and hybrid vehicle changing systems and Internet gaming.

Representative Matters:
  • Conducted a thorough analysis of the inventive concepts and a review of the technical and commercial viability of a proposed cellular communication architecture prior to initiation of patent protection. As a result, he developed a forward-looking patent portfolio, on a worldwide basis, to protect a revolutionary 3G cellular multicasting architecture. The patents in this portfolio address not only the generic multicasting feature, but also various network architectures, services and the communication devices operational in the network. The resultant patent filings predated by three years the integration of this feature into the 3G cellular standard. The target U.S. market for this technology is on the order of $400-500 billion over the life of these patents.
  • Developed a powerful IP portfolio to secure the rights to provide economical air-to-ground wireless communication services. This portfolio includes patents, on a worldwide basis, that define not only the basic network architecture and service offering, but also revenue generating services that can be provided using this network architecture. The resultant patent portfolio dominates this field and provides the patent owner with the preeminent position in this market.
  • Prepared and is prosecuting a number of patents in the field of dynamic electronic advertising. These patents address a new advertising paradigm which enables advertisers to precisely control product placement on a customized basis. This system dynamically modifies the content of a multimedia program as it is delivered to the individual recipient to integrate selected products into the multimedia program.
  • Through a long-term relationship with a client, developed a portfolio of patents which is directed to stored air energy powered foam delivery systems for decontamination and fire retardant. This work has migrated to the field of using controllably-charged fluids for hydrocarbon recovery, radiological/nuclear/chemical and microorganism suppression.
