Bizunesh Scott’s practice focuses on complex litigation, government investigations, and legal counseling. Ms. Scott often simultaneously represents clients before government agencies and in private lawsuits.  She has defended clients during government agency investigations, criminal investigations, class actions, civil actions, and with respect to changes in management.  More specifically, her civil representation includes complex state and federal civil actions alleging securities fraud, RICO violations, ERISA violations, False Claims Act violations, patent infringement, breach of contract, wrongful termination, fraud, and breach of fiduciary duties.  She has represented businesses and individuals that were under investigation by the Securities Exchange Commission (SEC), Department of Justice (DOJ), and Federal Trade Commission (FTC).  The investigations were based on a variety of allegations including accounting fraud or improprieties, FCPA violations, improper trading, market manipulation, and consumer fraud.

Ms. Scott provides strategic legal advice and counsel on corporate compliance, Sarbanes-Oxley duties, litigation risk, cost-effective electronic discovery management, document retention policies, and coordinating defense efforts.   She also has experience with innovative tactics to resolve litigation, including producing documents and information for settlement purposes, creating third party solutions, jury testing, stakeholder analysis, and business value/risk assessments.

Before joining Patton Boggs, Ms. Scott practiced at a large, international New York-based law firm.  For six months of her time there, she worked at the Legal Aid Society of the District of Columbia, defending eviction actions in the Landlord-Tenant Branch of the D.C. Superior Court and administrative proceedings at the D.C. Housing Authority.

Representative Matters:
  • Represented a large engineering company as they established international operations and developed international business compliance programs, including programs to comply with the FCPA, export restrictions, and anti-boycott laws.
  • Lead counsel representing a CFO in a criminal and civil health care fraud and criminal obstruction of justice investigation.
  • Represented one of the largest consulting firms in the world faced with SEC investigations into accounting practices and possible non-compliance with the FCPA, DOJ investigations, securities fraud class actions, and derivative lawsuits. Ms. Scott played a significant role in the briefing that resulted in the district court dismissing the securities fraud class action with prejudice on a motion to dismiss. In re BearingPoint Sec. Litig, 2007 WL 2713906 (E.D. Va. Sept. 12, 2007).
  • Represented a major former cellular provider facing multi-district federal and state litigation related to the consolidation of the ownership of various subsidiaries that operated as partnerships and corporations. Ms. Scott was instrumental in the briefing in the trial and appellate court that led to the dismissal with prejudice of RICO, securities fraud, and breach of contract claims.
  • Represented a Fortune 500 company faced with a wrongful termination lawsuit by a senior executive based on allegations that the senior executive was terminated for discovering fraudulent activity within the company. Ms. Scott assisted with an aggressive discovery plan that allowed for a favorable settlement.
  • Represented a former senior executive of a Fortune 500 company facing allegations of accounting improprieties. Ms. Scott represented the client in the government investigation, internal company investigation, related securities class action, and related ERISA class action, as well as assisted the client in negotiating with the former employer with respect to indemnity and severance. The SEC closed its investigation with no action against the individual or the company.
  • Represented an individual whose complaint had been dismissed with prejudice for failure of service. Ms. Scott briefed the issues and argued the case before the D.C. Court of Appeals. In a published opinion, the appellate court reversed the trial court and reinstated the case. Ms. Scott was also able to negotiate a favorable settlement for this client. Packheiser v. Miller, 875 A.2d 645 (D.C. 2005).
