Cheryl Jerome Moore is an experienced trial lawyer who assists clients with matters of white-collar criminal, complex commercial, and securities litigation, as well as federal and state securities enforcement and regulatory issues. During her career, Ms. Moore has handled litigation throughout the U.S., Europe, and Latin America. She is a former prosecutor at the Dallas County District Attorneys’ office, where her efforts led to her promotion to Chief Felony Prosecutor, and head of the Commercial Fraud Section of the Specialized Crime Division, where she concentrated on securities and complex commercial prosecutions.

Ms. Moore provides her strategic litigation advice throughout the U.S. and internationally, as well. She represents domestic and foreign clients singularly and in parallel proceedings before the Securities and Exchange Commission (SEC) and the Financial Industry Regulatory Authority (FINRA) in public and private matters. Additionally, Ms. Moore practices law in regulatory, enforcement, and criminal proceedings in the U.S., Europe, and Latin America. She provides counsel on conducting internal investigations and addressing related Sarbanes-Oxley issues for companies and/or boards of directors.

Furthermore, Ms. Moore represents public and private corporations in complex commercial and private securities litigation. She was involved in the creation of the legislative, regulatory, and oversight framework for a financial free trade zone in Latin America.

Ms. Moore is also an arbitrator for NASD and FINRA. She is immediate past Deputy Chair of the firm’s Litigation Department and a member of the firm’s Management Committee.

Representative Matters:
  • Successfully prosecuted and defended hundreds of jury trials during the course of her career in all types of criminal fraud theft offenses.
  • Successfully prosecuted civil theft case for a financial institution located in the Dominican Republic, awaiting a judgment in excess of $31 million.
  • Successfully defended a series of lawsuits brought by joint venture partners against general partner alleging fraud, misrepresentation, breach of fiduciary duty, and securities laws violations.
  • Defended national broker/dealer in customer suits brought as a result of multi-million dollar broker theft and representation in the resulting four-year SEC investigation culminating in the issuance of a new action letter.
  • Successfully defended national broker/dealer, its brokers, and analysts in an NASD arbitration involving claims that the firm artificially inflated the price of stock, convinced the customer to buy and hold the stock, and failed to apprise the customer of material negative information and conflicts of interest.
  • Successfully defended national broker/dealer in an NASD arbitration wherein it was alleged that the firm failed to apprise the customer that his authorized trader/financial advisor was under SEC investigation and subject to an SEC permanent injunction.
  • Thomas v. Bear Stearns & Co. Inc., 196 F.3d 1256 (5th Cir., 1999); Thomas v. Bear Stearns & Co. Inc., 1998 WL 684232 (N.D. Tex., 1998): Successful prosecution of confirmation of arbitration award in Title VII employment claim, and defense of appeal of appeal of arbitrability and merits of Title VII employment claim.
  • Steehler v. Product Development Corp., 2001 WL 196981 (N.D. Tex., 2001): Successful defense of employment claims under 42 U.S.C. Section 1981, Section 1983 and Section 1985(3).
  • Successfully prosecuted action against operator and working interest owner of oil and gas wells on behalf of client who subsequently took over operation of such wells.
  • Defended oil and gas exploration company in several actions brought by employees of some contractors/vendors for personal injuries sustained during drilling and/or completion operations.
  • Defended theft of intellectual property for manufacturing company brought by a competing manufacturer for claims of infringement and misappropriation of trade secrets.
  • Successfully defended national public telecommunications company in trade dress dispute.
  • Defended public brokerage firm in obtaining a Permanent Injunction against former employee who posted confidential company information and harassing material in Internet chat rooms.
  • Obtained injunctive relief arising from state law trade name claims for national distributor.
