As an at-large member of the firm’s Management Committee, and chair of the firm’s Energy, Natural Resources, Environmental, Health and Safety practice group, David Farber provides clients with strategic solutions to complex political and litigation problems. He maintains a broad and diverse legal practice, ranging from health care litigation and advocacy to health and safety regulatory work. He has served as lead counsel in a number of complex litigations, including several high-profile, “bet the company” matters. He also serves as a litigation and business strategist, providing clients with counseling and direction across a variety of fields.

Mr. Farber has particular expertise in health care regulatory and litigation issues, insurance law, health and safety (OSHA and MSHA) disputes, environmental law, False Claims Act (health care and environmental) litigation, trade secret and employment issues, and business counseling. Mr. Farber has also helped organize and serves as lead counsel for several trade associations, addressing a variety of federal and state issues. He also represents high-profile political candidates, both during and after election cycles. 

Representative Matters:
  • Pittston Co. v. Allianz Ins. Co., 905 F. Supp. 1279 (D.N.J. 1995), reversed in part, 124 F.3d 508, 521 (3d Cir.1997): Lead counsel in complex, multiparty environmental insurance coverage litigation, which set national precedent on significant coverage issue.
  • Rwanda v. Rwanda Working Group, 227 F. Supp.2d 45 (D.D.C. 2002): Lead counsel in precedent setting litigation over scope of foreign country ambassador’ authority. Obtained civil and punitive damages against attorney who aided former ambassador in converting government funds. See also Republic of Rwanda v. Uwimana (In re Uwimana), 274 F.3d 806, 811 (4th Cir.2001) (related bankruptcy case against former ambassador). 
  • United States, ex rel. Wilkins v. North American Constr. Corp., 173 F.Supp.2d 601, (S.D.Tex.2001): Lead counsel in complex False Claims Act case which established jurisdiction precedent on materiality standards and pleading requirements in FCA claims litigation.
