DeMaurice Smith is a trial lawyer and litigation partner at Patton Boggs who concentrates in white-collar criminal defense and “bet the company” tort liability trials.  He is Chair of the firm’s Government Investigations and White-Collar Practice Group.

Mr. Smith is a seasoned lawyer who has held lead or “first chair” responsibility in more than 80 federal and state jury trials to verdict.  He has argued numerous cases before the U.S. Court of Appeals for the District of Columbia Circuit and the District of Columbia Court of Appeals, and he has defended individuals in high profile criminal cases and Congressional investigations while also representing Fortune 500 companies in criminal and complex civil cases, compliance matters, and internal investigations. 

White-Collar Criminal Defense and Congressional Investigations

Mr. Smith represents corporations and individuals in both criminal and administrative matters, notably those pending before the U.S. Attorney’s Office, Department of Justice (DOJ), U.S. Congress, DOJ Antitrust Division, and the Securities and Exchange Commission (SEC).  He has tremendous experience in cases alleging conspiracy, environmental crimes, accounting fraud, health care, securities, obstruction, antitrust, false statements, and defense contractor fraud, including:
  • Representation of the General Counsel at one of the U.S.’s largest health care services provider in criminal and Congressional investigation
  • Trial of radio executive in insider trading allegations
  • Numerous representations of corporate executives in criminal and civil trials and corporate internal investigations
  • Representation of major government contracting firm before U.S. Congress in oversight hearings

Complex Civil Litigation
  • Corporate trial representation in complex civil cases and arbitrations, class action litigation, complex personal injury, and mass tort trials
  • Lead Trial Counsel for a designer, manufacturer, and marketer of electrical transformers in more than 3,000 claims alleging PCB contamination in Mississippi
  • Representation of the world’s third-largest automaker in insurance subrogation, personal injury, and business interruption claims following an explosion of a power plant
  • Lead Trial Counsel in representation of a multinational pharmaceutical company in PPA litigation in New York and Philadelphia

A native Washingtonian from Anacostia, Mr. Smith served from 1991-2000 as an Assistant U.S. Attorney in the District of Columbia U.S. Attorney’s Office, including service as a senior prosecutor in the Violent Crime Section and the Transnational / Major Crimes Sections of the office.  Mr. Smith then served as Counsel to Deputy Attorney General Eric Holder.  He was also the U.S. Attorney’s Office’s Lead Representative to the Law Enforcement Inaugural Committee and served in the U.S. Secret Service’s Multi-Agency Command Center during the 2001 Presidential Inauguration.

Mr. Smith is a frequent commentator on MSNBC’s Hardball and The Abrams Report, and on CNN, NBC, Court-TV, and Fox television.  He teaches classes on trial advocacy at the University of Virginia, George Washington University, and American University.
