Edward Gehres is a litigator focusing on complex civil litigation, products liability, mass torts and health care disputes. He has extensive trial-level experience in state and federal courts as well as with alternative dispute resolution methods. Mr. Gehres also practices in the firm’s Native American Affairs group, representing tribal and Native American-owned entities in non-gaming economic development matters.

As a litigator, Mr. Gehres has significant experience with complex multiparty matters involving consumer protection statutes, product liability claims, mass and catastrophic torts and health care providers. He has represented clients at trial and on appeal in state and federal class action cases as well as multi-district litigation. Mr. Gehres excels at crafting novel strategies regarding scientific and health effects issues. From the management of testifying experts in numerous medical and scientific specialties to the supervision of large-scale consulting expert projects, he has handled the development and presentation of complex scientific issues from the earliest stage of identification through the trial phase and, when necessary, into the appeals process.

In his Native American Affairs practice, Mr. Gehres counsels Indian-owned businesses, tribal enterprises and economic development organizations in a wide range of strategic, business and risk management issues. His work has focused recently on food, agricultural and consumer products companies in Indian Country. He has also served as counsel in litigation disputes involving federal administrative issues, tribal governance and contract matters. Mr. Gehres is of Eastern Band Cherokee heritage and served on the Executive Board of the Native American Bar Association of Washington, DC from 2005 until 2008.

Representative Matters:

Litigation 
  • In re: Kansas Medicaid Pharmaceutical Average Wholesale Price Litigation – Defending a pharmaceutical manufacturer in a multiparty consumer protection enforcement action brought by the Kansas Attorney General. 
  • In re World Trade Center Disaster Site Litigation – Management of defense efforts regarding scientific and expert issues for the City of New York and more than 150 contractors in multidistrict litigation arising from response actions taken at the World Trade Center after the 9/11 terrorist attacks. 
  • In re: WellNx Marketing and Sales Practices Litigation – Representing an ingredient supplier in third-party action related to a multidistrict consumer protection class action. 
  • In re: Enron Power Marketing – Trial counsel to a Washington State electrical utility in a successful trial against Enron trading entities for fraud and market manipulation during the western energy crisis. Court’s initial decision ordered Enron to disgorge $1.6 billion. 
  • Isofoton, S.A. v. Giramberk – Represented Europe’s largest manufacturer of solar cell technology in federal court litigation with former distributor for the Americas, Asia and the Pacific Rim. First chaired efforts to resolve issues in mediation and then secured favorable decision on all remaining issues in binding arbitration. 
  • Gifford v. Daniels Tire Service – Successfully defended tire and auto service chain in 12-week trial involving novel product liability and catastrophic tort claims arising from a Ford Explorer rollover accident. 
  • Gaines vs. Krawczyk and Diocese of Pittsburgh – Represented estate of 19-year-old University of Pittsburgh football star in obtaining a multimillion dollar settlement for wrongful death and negligent supervision claims. 
  • Omnicare v. Illinois Dept. of Healthcare and Family Services – Representing nation’s largest long-term care pharmacy company in a multimillion dollar Court of Claims Medicaid reimbursement case against the State of Illinois. 
  • In re: Kindred Pharmacy, et al. – Successfully resolved over $7 million in Medicaid recoupment disputes with the State of Indiana on behalf of more than a dozen long-term care pharmacy operations.

Native American Affairs 
  • Serve as principal outside counsel to Native American Natural Foods, counseling the company from its inception on strategic business issues while coordinating representation in intellectual property, contracts, business organization and federal agency matters. 
  • Serve as outside general counsel to the Lakota Funds, Indian Country’s oldest Community Development Financial Institution, including the resolution of a “bet the company” dispute involving a housing development financed by the Low Income Housing Tax Credit program. 
  • Successfully represented the Native American Rights Fund in a dispute with the Office of Personnel Management over Combined Federal Campaign participation.
