It’s a consistent refrain: “I don’t need to worry about export issues because I have a US Government contract, and that’s all I need to export!” In some cases, however, these can turn out to be famous last words by companies that suddenly find themselves trapped between a US Government agency demanding contract performance and a US Government “licensing” agency expecting compliance with the export laws.
Unfortunately, companies may realize too late that a US Government contract does not relieve them of licensing, recordkeeping or other requirements under the ITAR, EAR and other export regulations. And perhaps more surprisingly, US Government agencies can fail to appreciate the breadth of application of these laws – laws which extend to the actions of the Government as well.
How does one deal with these issues, and what do some recent attempts by the Department of Defense to revise the DFARs regarding export compliance really mean?
