Haydn J. Richards, Jr. advises members of the financial services industry on state and federal regulatory matters. The focus of his client service efforts include state licensing matters pertaining to mortgage lenders, brokers, servicers and their employees, as well as licensing matters pertaining to other real estate settlement service providers. Mr. Richards frequently prepares multistate regulatory surveys regarding all aspects of regulatory compliance for mortgage companies and other settlement service providers. He regularly assists clients with internal and external compliance surveys, facilitates interaction with regulatory agencies and assists with all aspects of state and federal audits, examinations and enforcement actions. 

Mr. Richards has been deeply involved with the development and testing of the Nationwide Mortgage Licensing System (NMLS) and spoke on legal issues pertaining to the system at the inaugural and second annual NMLS User Conferences. Mr. Richards is a member of the NMLS Industry Development Working Group (IDWG), a panel of industry members that directly advises upon the development and continued implementation of the NMLS.

Representative Matters
  • Performed an audit of a national mortgage lender’s licenses and approvals to ensure full compliance with state laws and regulations.
  • Drafted polices and procedures and implemented risk-limitation measures and strategies to ensure that a client was in a position to comply with federal and state background check requirements.
  • Assisted with numerous multistate licensing initiatives, including: (1) obtaining licensing approvals so that entities were in a position to conduct business in each of the 50 states and Washington DC; and (2) obtaining approvals in connection with stock acquisitions of licensed mortgage companies.
  • Assisted with drafting a comment letter to the Department of Housing and Urban Development’s proposed regulation on the SAFE Act.
  • Assisted a client in responding to a state regulatory examination report.
  • Assisted a client with developing marketing materials that complied with state and federal advertising requirements.
