James Copley has represented clients in federal and state courts throughout the United States for more than twenty years.  He also has substantial experience in litigating matters before American Arbitration Association panels.  Mr. Copley’s litigation practice is centered around complex commercial litigation, with an emphasis on the defense of product liability cases.

Notably, Mr. Copley represented a major cigarette manufacturer in dozens of product liability lawsuits nationwide for over a decade.  He also defended that client against statewide and national class actions in both federal and state courts.  Mr. Copley was part of trial and appellate teams in a number of landmark cases involving both class actions and cases brought on behalf of individual plaintiffs.

In addition, Mr. Copley’s experience includes the defense of numerous class actions both in the context of other product liability claims and in other commercial disputes.  He also has a special interest, and years of experience, in the development of expert testimony on a wide array of sophisticated scientific, medical, and economic issues pertinent to product liability and intellectual property matters.

Representative Matters:
  • Defended a manufacturer of cigarettes against product liability claims, alleging personal injuries, brought on behalf of individuals and on behalf of statewide and national classes.
  • Defended a manufacturer of video games against product liability claims, alleging personal injuries, brought on behalf of a class.
  • Defended a member of a bank board of directors against claims brought by shareholder and depositor classes in the wake of a seizure of bank assets by federal regulators.
  • Defended a manufacturer of sporting goods in connection with a Consumer Product Safety Commission investigation.
