John Corbett focuses on a wide range of environmental, commercial, construction and transportation matters, including litigation, compliance and enforcement, regulatory counseling, and transactions. Mr. Corbett’s extensive experience includes representation of major industrial clients in federal and state hazardous waste, toxic tort, and Clean Air Act litigation and enforcement matters; counseling in environmental permitting, rail and other transportation, land use, and remediation; and negotiating environmental issues in mergers and acquisitions and commercial lending transactions.
Mr. Corbett’s pro bono representations concentrate in the area of special education/special needs rights advocacy and associated administrative matters with New Jersey Division of Developmental Disabilities.
Before joining Patton Boggs, Mr. Corbett was an associate in the environmental practice groups at two major firms in New York and New Jersey. He previously worked for 14 years in the oil and gas and tanker industries as a commercial broker and consultant on international petroleum trade issues.
Representative Matters:
- Represented major automobile manufacturer in New Jersey Department of Environmental Protection (NJDEP) enforcement proceedings related to decommissioning of former manufacturing facility, and associated actions (DNJ) for environmental cost recovery, breach of contract, violations of the Racketeer Influenced and Corrupt Organizations Act (RICO) and contractor/subcontractor claims.
- Defended real estate investment trust (REIT) in multi-district litigation (SDNY) involving claims brought by public water purveyors against petroleum suppliers related to alleged contamination of public water supply wells with gasoline additive methyl tertiary butyl ether (MTBE).
- Represented industrial manufacturing company in federal and state (NJ) administrative actions related to remediation of the Passaic River (NJ) and natural resource damages claims.
- Represented industrial manufacturer in contractual indemnification and cost recovery suit (DNJ), successfully obtaining full defense and indemnification for all environmental costs associated with remediation of Passaic River.
- Represented major transportation company in contractual indemnification dispute resolution related to environmental costs associated with Newark Bay (NJ and NY).
- Represented insurer in subrogation/cost recovery action (CD Cal.) against United States related to environmental issues associated with federal government defense contract munitions production.
- Represented hazardous waste transportation and disposal company in administrative proceedings associated with siting of solid/hazardous waste rail transload facility in New Jersey.
- Represented automobile manufacturer in federal and state (NJ) enforcement proceedings relating to remediation of Superfund (CERCLA) National Priorities List (NPL) site in New Jersey.
- Represented major oil company in multi-district litigation (SDNY) involving claims brought by public water suppliers against petroleum industry for alleged contamination of public water supply wells with methyl tertiary butyl ether (MTBE).
- Represented major oil company in negotiations with U.S. Environmental Protection Agency (EPA) and U.S. Department of Justice (DOJ) to settle alleged violations of New Source Review provisions of Clean Air Act.
- Represented major oil company in settlement of alleged violations of New York State Department of Environmental Conservation (NYSDEC) petroleum bulk storage and chemical bulk storage regulations.
- Represented major oil company in settlement of alleged violations of New Jersey Title V (Clean Air Act) permit for petroleum bulk storage facility.
- Defended major oil company in Resource Conservation and Recovery Act (RCRA) citizens suit (SDNY) seeking injunction compelling remediation of former manufacturing site in New York City suburb.
- Defended apparel manufacturer in NYSDEC suit (WDNY) seeking cost recovery for remediation of landfill in Upstate New York.
- Defended cosmetics manufacturer in suit (EDNY) seeking cost recovery for remediation of landfill in Long Island, New York.
- Represented pro bono preservation group in efforts to limit scope of planned resort development in Upstate New York communities.
