Kevin McCart focuses his practice on white-collar criminal defense, internal investigations and complex civil litigation. Mr. McCart is an experienced trial lawyer and investigator who has served as lead counsel in criminal and civil matters in federal district and circuit courts as well as military courts-martial. He draws on his experience as a government attorney to represent corporate and individual clients in all forms of litigation involving the government. Mr. McCart assists clients in responding to criminal and civil government investigations throughout the country and the parallel administrative, regulatory and civil litigation that often accompanies those investigations. He defends clients in investigations conducted by the Department of Justice, the Federal Trade Commission, Department of Labor, and the Department of State, as well as other state andfederal entities. Mr. McCart also represents a major international labor union in internal investigations and prosecutions under the union’s constitution.
In addition to his government enforcement work, Mr. McCart is an experienced civil litigator, representing both plaintiffs and defendants at the state and federal level in RICO, fraud, breach of fiduciary duty and breach of contract disputes. He has successfully utilized both mediation and arbitration to further his clients’ civil litigation objectives.
Before joining Patton Boggs, Mr. McCart served as an active duty Army judge advocate. While on active duty, he gained considerable trial experience as a felony prosecutor. Mr. McCart also served as a civil litigation attorney in the Army’s Litigation Division, defending the Departments of Defense Army and their officials in federal civil litigation across the country. He deployed to Afghanistan as the Brigade Legal Advisor for the 173rd Airborne Brigade during Operation Enduring Freedom, providing legal advice on military prosecutions, contract law, detainee operations, reconstruction, rules of engagement/law of war, international agreements and Afghanistan rule of law development. While in Afghanistan, Mr. McCart led sensitive criminal and administrative investigations into allegations of detainee abuse, fraud and war crimes.
