Mary Beth Bosco counsels new and experienced government contractors on matters involving contract compliance and opportunities in the federal marketplace. She draws on over 20 years of experience with both regulatory and litigation matters, incorporating a “best practices” approach. Ms. Bosco provides practical guidance to emerging companies entering the federal government market and has particular understanding of the Small Business Innovative Research (SBIR) program. She also advises seasoned corporations on how to best navigate complex federal contracting issues, and has guided numerous companies through procurement fraud investigations.

In addition, Ms. Bosco represents investment funds and financial institutions in connection with the due diligence review of government contractors.  She regularly leads a seasoned team of government contracts attorneys in evaluating the specialized issues involved in the acquisition or financing of a government contractor, including Congressional appropriations and program oversight, national security, cost accounting and revenue recognition, and compliance and litigation risks.

Ms. Bosco also represents clients on environmental issues before EPA, and litigates NEPA and Superfund cases. Ms. Bosco uses her government contracts skill in the environmental field, particularly in the areas of False Claims Act litigation involving environmental remediation contracts, environmental cost recovery and indemnification issues under contracts with the federal government, and the interaction between NEPA and federally-funded, privately-performed contracts.

Ms. Bosco is a member of the firm’s Executive Committee, head of the Government Contracts and Federal Marketing Practice Groups, and co-chair of the Diversity Committee.

Representative Matters:
  • Successfully defended an environmental remediation company in a False Claims Act case involving a three-week trial, and an appeal to the U.S. Court of Appeals for the 8th Circuit, and a petition for certiori to the U.S. Supreme Court.
  • Worked closely with a large pharmaceutical company to review and revise the company’s small business subcontracting program from the bottom up, including development of instructions, training materials, and standard operating procedures.
  • Negotiated a compliance agreement with the government, worked with the company to implement and monitor performance of the agreement, and advised the company in connection with an agency audit of the company’s adherence to the requirements of the agreement, which resulted in a letter of commendation to the company from the agency.
