Michael Mellen focuses his practice on government investigations and national security issues, with a particular emphasis on export/import control and compliance. He advises clients on these matters before the U.S. Departments of State, Commerce, Treasury and Defense. Mr. Mellen has conducted transactional investigations that have implicated both U.S. and foreign export control regimes, as well as the data protection and privacy laws of multiple nations. He advises companies on issues involving technology transfer, licensing, industrial espionage, export transactional due diligence, audits, investigations and the governing export/import regimes. The majority of Mr. Mellen’s clients have been in the defense, high technology and private security industries, including firms specializing in satellites, software, military technology, training and computers. He also assists clients under federal criminal investigation, including responding to grand jury subpoenas.
Mr. Mellen has also advised clients on matters relating to the National Industrial Security Program Operating Manual (NISPOM) and the Defense Security Service (DSS). In addition, he has prepared submissions to the Committee on Foreign Investment in the United States (CFIUS), and assisted clients with matters before investigatory committees of the U.S. Congress.
Before joining Patton Boggs, Mr. Mellen worked in litigation, concentrating in commercial and business disputes. He has represented clients in federal and state courts throughout Washington, D.C. and Virginia.
During law school, Mr. Mellen was a member of the Vanderbilt Business Law Clinic, in which he advised start-up companies on business formation and contractual issues. He also worked at other law firms, advising clients on federal environmental and energy regulations.
