Mike Schaengold specializes in government contracts litigation and counseling, and in litigation before the U.S. Court of Appeals for the Federal Circuit and the U.S. Court of Federal Claims.

Mr. Schaengold’s substantial government contract dispute and bid protest experience includes the successful litigation of major cases before the Government Accountability Office (GAO), the Court of Federal Claims, the Court of Appeals for the Federal Circuit and the Boards of Contract Appeals. He has represented clients in disputes involving most major departments and agencies of the U.S. Government and, in recent years, has focused on procurements involving the Department of Defense, the General Services Administration, the U.S. Postal Service, the National Aeronautical and Space Administration (NASA), the Department of Homeland Security and the Department of Energy. He also has substantial experience in due diligence reviews and other issues related to the acquisition, merger, spin-off or sale of government contractors.

Mr. Schaengold also represents clients in patent appeals to the Court of Appeals for the Federal Circuit and in patent/government contracts litigation against the U.S. Government in the Court of Federal Claims. He has successfully represented clients in some of the largest appeals to the Court of Appeals for the Federal Circuit, including several valued at in excess of $1 billion. He has been appointed by the last three Chief Judges of the Federal Circuit to that Court’s Advisory Council and/or Rules Advisory Committee. Currently, he is Co-Chair of the Federal Circuit’s Advisory Council and, by appointment of the last two Chief Judges of the Court of Federal Claims, a Member of the Court of Federal Claims’ Advisory Council. Super Lawyers has selected him as a “Washington, D.C. Super Lawyer.”

From 1986 to 1988, he served as a law clerk on the Court of Federal Claims and, subsequently, on the Court of Appeals for the Federal Circuit to former Chief Judge Haldane Robert Mayer.

Representative Matters
  • Victorious bid protests (including obtaining preliminary and permanent injunctions), bid protests where corrective action was taken by various federal agencies in response to protests on behalf of our clients, and the settlement of bid protests, which led to multi-million dollar contract awards to clients and/or allowed clients the opportunity to compete for, and win, government contract awards.
  • A judgment by the Court of Federal Claims, which was affirmed by the Federal Circuit and collected by the client, against the U.S. Government in a government contracts case for more than $97 million.
  • The successful challenge in the Armed Services Board of Contact Appeals on behalf of twenty major manufacturers to government claims asserted under a “most favored customer” clause of a Department of Defense contract.
  • A major ruling by the Court of Appeals for the Federal Circuit and the Court of Federal Claims concluding that, while a federal statute prevented the Secretary of the Navy from adjusting shipbuilding claims older than 18 months, the statute in no way limited the authority of a court to adjudicate such claims.
  • Numerous victories in the Court of Appeals for the Federal Circuit, including in multi-million and billion dollar patent and government contracts cases involving reversals of trial court decisions.
  • Multi-million dollar settlements of government contracts and patent claims against the U.S. Government.
