EMPLOYMENT LAW ALERT: The Genetic Information Nondiscrimination Act of 2008 is Now in Effect

The employment law provisions of the Genetic Information Nondiscrimination Act of 2008 (“GINA”) are now in effect. As of November 21, 2009, covered employers are prohibited from using genetic information in employment-related decisions, classifying employees based on genetic information or requesting genetic information from an employee. Covered employers also must maintain the confidentiality of genetic information.
