The employment law provisions of the Genetic Information Nondiscrimination Act of 2008 (“GINA”) are now in effect. As of November 21, 2009, covered employers are prohibited from using genetic information in employment-related decisions, classifying employees based on genetic information or requesting genetic information from an employee.
