Nicola Shiels’ practice focuses on complex litigation. As a litigator, Ms. Shiels has extensive courtroom experience, including trying nearly 20 cases to verdict or judgment. She has litigated cases involving securitized loan pools, intellectual property infringement, contract disputes, and other business torts. Her courtroom experience includes serving as an Assistant District Attorney with the Dallas County District Attorney’s office.

In addition, Ms. Shiels maintains an active practice in assisting clients with protecting their internet domain names under the Uniform Domain Name Dispute Resolution Policy. As part of this practice, she frequently appears before the National Arbitration Forum.

Representative Matters
  • Represented nation’s largest HVAC repair company against nation’s second-largest HVAC repair company for trademark infringement, unfair competition, and dilution under state and federal law, resulting in a confidential settlement.
  • Represented nation’s largest swimwear specialty store defending against Texas’ largest swimwear specialty store for trademark infringement, unfair competition, dilution under state and federal law, and breach of contract, resulting in confidential settlement.
  • Represented a trust seeking repurchase of a $3.6 million mortgage loan secured by health care facility for failure to perfect security interest on personal property. LaSalle Bank, N.A. v. Capco American Securitization Corp., No. 02 CV 9916(RLC), 2005 WL 3046292 & 2006 WL 177169 (S.D.N.Y.).
  • Represented a trust seeking repurchase of seven mortgage loans secured by real property across the United States for failing to perform due diligence and pre-securitization servicing. Successful defense of all claims against the seller’s summary judgment motions, resulting in confidential settlement after voir dire.
  • Represented a trust seeking repurchase of four mortgage loans secured by real property across the United States for failing to perform due diligence and pre-securitization servicing. Successful summary judgment motion granting the special servicer the right to pursue action against the mortgage loan seller; successful defense of all claims against the seller’s summary judgment motions, resulting in confidential settlement after voir dire.
  • Represent a trust seeking repurchase of a $9 million mortgage loan secured by multi-family property for failure to perform warranted origination due diligence and pre-securitization servicing. Action pending.
  • Breach of contract action for termination of mail processing contracts at facilities located in Charleston, WV, Richmond, VA, Norfolk, VA, and Charlotte, NC. Pursuit of aggressive pre-trial schedule resulted in quick, confidential settlement.
