Patrick Gilmartin’s practice centers on mass and toxic tort defense, product liability, environmental and general commercial litigation, as well as international arbitration. Mr. Gilmartin participates in the representation of municipalities, offshore businesses litigating against sovereign governments, agricultural biotechnology corporations, military contractors, disaster responders and construction companies in state, federal and international tribunals. Prior to attending law school, Mr. Gilmartin worked in institutional financial services with the oldest bank in the United States, as well as one of the major U.S. investment banks, where he spent each summer throughout college.
Mr. Gilmartin’s pro bono work has resulted in several successful outcomes, including the opposition to an international child custody/abduction petition that was dismissed by the U.S. Court of Appeals for the Third Circuit, permitting a child to stay with her mother in the United States. Separately, Mr. Gilmartin acted as co-lead counsel in a successful appeal to the U.S. Court of Appeals for Veterans Claims over the denial of benefits for a Korean War veteran.
Prior to joining Patton Boggs, Mr. Gilmartin was an associate at one of the foremost U.S. law firms based in New York City. Mr. Gilmartin was also privileged to serve as judicial law clerk to the Hon. Katharine S. Hayden, U.S.D.J., in the U.S. District Court for the District of New Jersey. During law school, from which he graduated magna cum laude, Mr. Gilmartin served on the Seton Hall Law Review as a comment editor and associate articles editor.
Representative Matters
- Defended a large municipal corporation and more than 150 contractors and subcontractors regarding personal injury allegations during the rescue and recovery efforts, as well as the debris removal and cleanup operations following a terrorist attack.
- Defended a private military contractor against claims of genocide, war crimes and crimes against humanity brought under the Alien Tort Statute.
- Defended a marine services company in connection with negligence and OPA claims related to its response to a major off-shore oil rig fire.
- Represented an offshore company with claims against a sovereign government in a foreign arbitration.
- Represented a biotechnology company in a product liability suit related to the manufacture of military herbicides used during the Vietnam War.
- Successfully negotiated a settlement of commercial claims brought by a nutritional supplement manufacturer against its supplier.
