Richard Oparil has been actively engaged in litigating complex federal civil and white collar criminal matters throughout the United States for over 18 years. He helps biotechnology and other clients in patent infringement, trade regulation and complex business litigation at the trial and appellate levels. Having tried cases in federal and state courts and before administrative bodies, Mr. Oparil represents clients in high-profile investigations conducted by the Department of Justice, independent counsels, and Congress.

Prior to joining Patton Boggs, Mr. Oparil was a partner at two prominent Washington law firms.

Representative Matters:

In addition to having authored numerous successful federal appellate briefs, Mr. Oparil has represented clients, plaintiffs and witnesses in civil antitrust cases, Lanham Act cases, and Congressional hearings, such as "Filegate." Mr. Oparil has also:

  • Successfully defended a biotechnology company by obtaining judgment of patent invalidity.

  • Written a successful U.S. Supreme Court brief on patent standing and damages issues for a Japanese biotechnology company.

  • Represented a chemical company in the damages phase of a patent infringement suit.

  • Represented a senior officer and director of Enron Corporation in Congressional investigations.

  • Represented a witness at Congressional oversight hearings involving the selection of bid cities by the International Olympics Committee.

  • Represented a client in a campaign finance investigation by the Department of Justice and Congressional Committees.

  • Represented a not-for-profit student lending company in a $70 million breach of contract case against its former loan processor and servicer in the U.S. District Court for the District of Minnesota.

  • Represented a trade association in connection with an investigation by the Federal Trade Commission and state attorneys general of false advertising allegations.

  • Represented an internet publisher in a deception and unfair business practices action brought by the Federal Trade Commission and the New York Attorney General.
