Rick Simmons has extensive experience in complex commercial and corporate litigation. Mr. Simmons engages in all aspects of the litigation process including client interaction, pleadings preparation, written discovery, depositions, motions practice, hearings, settlement negotiations and trial preparation for intricate breach of contract and fraud matters. He also handles disputes between business entities and shareholder, member and partner controversies.

In addition to his litigation experience, Mr. Simmons assists with municipal finance matters related to municipal bond and warrant offerings, indenture analysis and creditor’s rights issues. He aids in advising clients regarding their rights and obligations in connection with municipal offerings under Municipal Securities Rulemaking Board rules and regulations and applicable federal and state laws.

While in law school at the University of Denver, Mr. Simmons achieved the highest grade in both his contracts and legal research and writing classes. As a member of the Denver University Law Review, Mr. Simmons’ article entitled “Reconciling Pleading Standards Under Pirraglia: the Private Securities Litigation Reform Act v. Federal Rule of Civil Procedure 12(b)(6),” which was chosen for publication in 2004.
