The specific privacy issues and strategies differ depending on the client’s business and the nature of the pertinent information. Common to all privacy areas is the need to strike an appropriate balance between individual rights, technological capabilities, and the legitimate needs and interests of business.

The following are among the many privacy-related projects on which we have worked:
  • Advise clients of pending privacy-related legislation and regulations affecting their interests, and represent those interests before Congress and regulatory agencies.

  • Assist clients in complying with the Gramm-Leach-Bliley Act, Children’s Online Privacy Protection Act (COPPA), Health Insurance Portability and Accountability Act (HIPAA), Can-Spam Act, Do-Not-Call, and other FTC and FCC regulations, as well as state privacy laws.

  • Conduct audits of client privacy and security policies and practices; assist clients in reviewing possible restrictions on sharing or transfer of customer, employee and other personal information in acquisitions, mergers and other corporate transactions.

  • Develop specific compliance and safeguards policies for the use and retention of personal information, customer information, medical and health information, and employee information.

  • Draft privacy policies and terms of use for websites and the handling of personal information obtained on-line.

  • Counsel clients regarding permission-based marketing strategies and other marketing initiatives.

  • Assist multi-national companies to implement privacy practices that conform to EU and international standards as well as US requirements.

  • Negotiate contracts pertaining to the acquisition, use and storage of personal information.

  • Represent clients in FTC investigations and proceedings relating to privacy issues.

  • Advise clients on identity theft, Fair Credit Reporting Act, and other consumer credit and identification issues.

  • Teamed with Cybrinth, a company that focuses on information security; technical risk analysis, computer systems and network diagnostics, and security development and analysis, to offer in-depth analysis and consultation to clients.
