Sally Garr co-chairs the firm’s Employment Law Group. For more than 25 years, she has helped employers respond to the changing legal landscape and its impact on their businesses. Ms. Garr has represented employers in litigating both individual and class actions in 23 jurisdictions in the United States. She has a proven track record of successfully defending her clients’ interests in cases alleging discrimination, harassment, wage and hour violations, breach of non-competition and confidentiality agreements, and employment-related tort claims.
In addition to litigation, Ms. Garr advises senior management and boards of directors on issues concerning executives and whistleblowers. She also assists employers in drafting executive employment agreements, developing personnel policies, and solving employment issues in ways that comply with the law and further her client’s business objectives.
Previously, Ms. Garr served as Associate General Counsel of Labor and Personnel at Amtrak. She knows first-hand the challenges faced by in-house counsel, executives, and human resource professionals. Her in-house experience gives her a pragmatic approach to solving her client’s legal problems.
Ms.Garr served for five years on the firm’s Management Committee. She also chairs the Firm’s Electronic Discovery Team, which provides strategic advice and detailed protocols to help clients meet the legal and technical challenges of preserving and producing electronically stored information when litigation is expected or ongoing.
Representative Matters:
Defeated plaintiffs’ motion to give notice to nationwide class in FLSA overtime case against a government contractor. Defeated plaintiffs’ motion for class certification in a sex and age discrimination class action against a financial institution. Obtained voluntary dismissal with prejudice after deposing plaintiff in race and age discrimination case brought against a financial institution. Obtained summary judgment for a security company in a sex discrimination and sexual harassment case. Obtained summary judgment for a retailer on a claim of sex discrimination in promotion and termination. Negotiated favorable resolutions to numerous Department of Labor audits of potential wage and hour violations and affirmative action compliance. Negotiated employment agreements for acquiring entity with executives of 18 companies being merged into a single nationwide entity.
