Stephen Hibbert specializes in major projects and infrastructure and international commercial arbitration. Mr. Hibbert’s experience spans over 25 years and includes being the lead attorney in numerous transactions in PPP/PFI–styled delivery systems and in the rail, toll roads and social infrastructure (schools, hospitals, water and utility systems) sectors.
Mr. Hibbert has worked throughout Australia, Asia, Hong Kong and China. In recent years, he has worked across the Middle East from a base in Abu Dhabi. Additionally, Mr. Hibbert is an internationally qualified arbitrator who is regularly appointed by arbitration bodies across the Middle East in major commercial and construction disputes. He has been retained throughout Asia for the independent assessment of claims and disputes, including acting for some of the major suppliers and contractors on issues arising from the Channel Tunnel Project. Mr Hibbert’s recent Middle East experience includes advising a number of international contractors working in the region on claims and on the management of disputes both in the local court systems of the UAE and in arbitration.
He was appointed adjunct professor at the University of New South Wales and has lectured there, in addition to the University of Sydney, for over 20 years in construction law and international arbitration.
Representative Matters
Mr. Hibbert regularly represents government and project financiers. His recent Middle East experience includes:
- Representing the government of Oman on three infrastructure and utility privatizations (water and power).
- Representing one of the largest contractors in the Gulf in its bid for a PPP-style program of multistory car parks in the city of Abu Dhabi.
- Advising international contractors working in the UAE on a wide variety of project issues, including contract administration; the assessment of claims and, in certain cases, the re-financing of projects.
- Acting as arbitrator on project disputes in the Middle East with individual values exceeding $100 million.
- Acting as lead counsel on a substantial dispute and resulting ICC arbitration, concerning the inadequate performance of a new, project-financed $500 million polypropylene plant in the Gulf.
- Acting as local counsel for one of the bidders on the sale of 25 percent of the Oman government’s holding in Omantel.
- Acting for Oman’s largest private bank in the development of a USD 1 billion Integrated Tourism Complex, to be built over 10 years in the South of Oman.
- Acting for the Oman Ministry of Transport on the redevelopment of Muscat airport (value in excess of USD 2 billion).
- Acting for Oman Refineries on all legal matters, including the development of a new (privately financed) poly propylene facility at Sohar; the development of a suit of procurement and project delivery contracts; and the management of disputes, including international (ICC) arbitrations.
