Suthima Malayaman focuses her practice on energy regulatory and commercial matters. Ms. Malayaman represents clients before the Federal Energy Regulatory Commission (FERC) and state public service commissions on energy matters, and has significant administrative litigation and settlement experience. She also advises lenders and investors on the regulatory risks associated with the financing and acquisition of electric and gas assets.

Ms. Malayaman regularly analyzes issues under the Federal Power Act, the Public Utility Regulatory Policies Act, the Public Utility Holding Company Act of 2005, the Energy Policy Act of 2005 and various state energy industry restructuring statutes affecting the domestic energy industry. In addition, she has been involved in representations before FERC and federal courts on behalf of independent power producers, project developers, energy traders and financial institutions.

Ms. Malayaman represents clients on matters related to transmission investment and open access, the development and implementation of rules relating to market power and mitigation and the development and operation of competitive wholesale energy markets and the rates, terms and conditions of power purchase and sale contracts, as well as reliability service contracts. She has obtained approvals from FERC for market-based rate authority, exempt wholesale generator status and qualifying facility status and regularly assists clients with all regulatory aspects of acquisitions, divestitures and financings of projects subject to FERC jurisdiction, including obtaining required FERC and state public service commission approvals.
