Samantha Petrich counsels clients in a variety of litigation practice areas, including general commercial litigation, complex civil litigation, internal corporate investigations, securities enforcement matters and white-collar criminal defense.
Ms. Petrich’s government investigations and securities enforcement practice consists of representing individuals and corporate clients in internal, grand jury and other investigations, as well as litigation brought by state and federal agencies and shareholders.
Ms. Petrich’s civil litigation practice consists of representing domestic and international clients in complex commercial litigation matters in state and federal court, at both the trial and appellate levels.
Representative Matters:
Government Investigations
- Represented regional financial institution, its board of directors and certain of its officers and employees in federal grand jury Bank Secrecy Act and anti-money laundering investigation and related regulatory matters. None of the individuals were criminally charged.
- Represented major non-U.S. company and its officers in debarment action before the Inter-American Development Bank. No action was taken against the company or its officers.
- Represented a national corporation and certain of its officers as witnesses in a criminal export control act investigation.
- Represented the former chairman of the audit committee a Fortune 500 corporation in an SEC option backdating investigation. No action was taken against the client by the SEC.
- Represented a Canadian accounting firm in an SEC option backdating investigation of a multinational corporation. No action was taken against the client by the SEC.
- Represented an accountant and his firm in a grand jury investigation of a U.S. congressman.
Civil Litigation
- Represented an international company in successive lawsuits filed in the U.S. District Court for the Southern District of New York and New York State Court relating to an alleged commercial transaction. Both cases were dismissed.
- Represented an international company and its executives in a lawsuit filed in the Northern District of Illinois relating to a dispute over claimed executive compensation. The case was resolved via a magistrate-led settlement.
- Represented a major home insurance company in a class action. The case was dismissed by the U.S. Court of Appeals for the Eighth Circuit.
