On May 20, 2009, the President signed the Fraud Enforcement and Recovery Act of 2009 (FERA) to expand the government’s ability to prosecute financial crimes. FERA also strengthened the already powerful False Claims Act (FCA) now used vigorously by federal prosecutors against healthcare providers, pharmaceutical and device companies, and government contractors. The amended FCA applies to claims made by recipients of Recovery Act funds, TARP payments and any other direct or indirect recipient of federal funds that are used “to advance a government program or interest.” In addition to expanding liability, the new FCA heightens the risks of investigation, creates penalties for holding “overpayments,” and encourages private “whistleblowers” to seek enormous rewards by filing even more actions alleging fraud against the federal government.
